Terms of Service

These Terms govern use of FedhAI at fedhai.com and related apps, mail, and payment pages (the Service). By creating an account, posting, paying, or using the Service, you agree to them. If you use FedhAI for an office, you confirm you are authorised to bind that office.

1. What FedhAI is

FedhAI is a public-finance record: offices publish budgets and projects; citizens ask on the published line; the owning office answers in public; oversight may read the same thread. The FedhAI reference mix and efficiency scores are rerunnable rules applied to a filed book. They are not a court finding, a Controller of Budget verdict, an audit opinion, or legal advice.

FedhAI is not a government organ, a gazette, IFMIS, or e-Citizen. Official figures come from published sources and from what an office files here. We do not warrant that any book is complete, current, or free of error.

2. Accounts and offices

  • You must be 18 or older and give a true name and email.
  • Statutory offices (national, county, ward, oversight, and listed partners) are activated by FedhAI. You may not invent one.
  • An officer seat is for the named office only. Impersonating an office, accounting officer, or oversight body is a material breach.
  • You keep credentials secret and are responsible for actions on your account.
  • We may suspend or close an account that is false, abusive, unpaid, or unlawful.

3. Public participation

Questions, replies, and related files on a budget or project page are a public record on the Service. Do not post secrets you are not allowed to publish. You retain your copyright. You grant FedhAI a worldwide, royalty-free licence to host, display, and keep that content so the thread remains the record.

You must not post:

  • defamation, threats, hate, or harassment;
  • spam, brigades, or automated flood;
  • unlawful, misleading, or infringing material;
  • personal data of a third party that you have no right to publish.

We may hide, cluster, or remove posts (including by automated triage) and report conduct required by law. An office reply is that office's statement, not FedhAI's.

4. Assistive tools

Where a plan includes them, tools may hide obvious spam and draft text from published numbers so an officer sees a real question. Outputs can be wrong. You remain responsible for what you file, publish, or send. Do not treat a draft as an official decision.

5. Plans and payment

Feature access follows the plan and office level described at checkout. Ward seats inherit from the parent county where that rule applies. Prices and taxes may change on notice for the next cycle.

  • Card payments are processed by Paddle. Their checkout terms also apply.
  • M-PESA STK, when offered, is processed through Safaricom Daraja.
  • Office quotations and invoices are issued by FedhAI when that rail is open.
  • Fees are due in the currency shown. Refund and cancellation rules are in the Refund and cancellation policy. Except where Kenyan law or the processor requires a refund, paid terms are non-refundable once the period starts.
  • Unpaid, reversed, or fraudulent charges may drop the seat to Starter and freeze paid tools.

6. Acceptable use

You may not probe, scrape at a harmful rate, reverse-engineer except as allowed by law, bypass access controls, resell the Service without consent, or use it to commit a crime. We may rate-limit, block, or take down to protect the record and other users.

7. Intellectual property

FedhAI, the folio mark, and the software are ours or our licensors'. Official public-finance figures remain public as the source law allows. You may not copy the platform or present our mark as a government seal.

8. Availability

We aim for a working Service. We do not promise uninterrupted access, and we may change or withdraw features. Preview hosts are not production.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY KENYAN LAW, FEDHAI DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that scores, drafts, or published pages will meet a statutory filing duty. You remain responsible for your office's legal obligations.

10. Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FEDHAI IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE LOSS, OR FOR LOST DATA, REVENUE, OR REPUTATION. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY TWELVE MONTHS IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICE IN THAT PERIOD, OR ONE THOUSAND KENYA SHILLINGS IF YOU PAID NOTHING. Nothing excludes liability that Kenyan law does not allow to be excluded (including fraud or death or personal injury caused by negligence).

11. Indemnity

You will defend and indemnify FedhAI against claims arising from your content, your misuse of the Service, your impersonation of an office, or your breach of these Terms or the law.

12. Law

These Terms are governed by the laws of Kenya. The courts of Kenya have exclusive jurisdiction, except that we may seek injunctive relief anywhere to protect the Service or the mark.

13. Changes

We may update these Terms. The date above will change. Continued use after the new date is acceptance. If you do not agree, stop using the Service and close the account.
